Pastoral Counselor’s Declarations of First, Fourth,
Sixth and Ninth Amendment Constitutional Rights and of Pastoral Counseling
Authorization Agreement and Informed Consent
I, Vijaya Stallings, M.A., formally and publicly declare and claim my First,
Fourth, Sixth and Ninth Amendment Constitutional Rights and the Rights conferred
by Article I, Section X of the U.S. Constitution.
I, Vijaya Stallings, M.A., declare that the ancient Yogic Healing Arts of India,
Tibet and Nepal (which include East Indian
Ayurveda and Tibetan Medicine), offer health education (pastoral
counseling) to modern civilization to keep the proper balance between body, mind
and consciousness (spirit). Through proper lifestyle, diet, cleansing regimes,
and rejuvenation programs the Ayurvedic Healing Arts have traditionally helped
one establish a long, healthy, fruitful and spiritual life. These healing arts
were first described in the Sanskrit and Tibetan languages in the ancient Hindu,
Buddhist, Yogic and Vedic scriptures and their commentaries such as the Yoga
Sutras of Patanjali, Tibetan Ambrosia Heart Tantra, and Charak, Sushrut, Vagbhat
and others. I declare that the Ayurvedic Healing Arts, although recently
introduced to the United States, have been practiced by both monastic and lay
practitioners in India for 2500+ years (since the time of Shakyamuni Buddha),
and in Nepal and Tibet for 1400+ years (since the arrival of Yogic Buddhism in
these countries). It is, however, not presently recognized by the medical
establishment of this country.

I declare that I am an Ayurvedic Pastoral Counselor and Ayurvedic Practitioner
(duly ordained Minister), commissioned by the California-based
non-profit 501(c)3 church,
called the Medicine Buddha Healing Center (www.Ayurveda-Berkeley.com
- also know as the “Ayurveda Holistic Institute of California”). I acknowledge
that I am a 1991 graduate of
Ayurvedic
Institute of renowned Ayurvedic Physician
Dr. Vasant Lad,
M.A.Sc. Furthermore, I declare that I have a
Master's degree in Counseling Psychology with a Holistic Health
Specialization from John F. Kennedy University, and in February 2000 I continued
advanced clinical Ayurveda study in the Indian Himalayas in Rishikesh at the
Rishikesh College of Ayurveda.
I desire to teach and share with you the Ayurvedic Healing Arts (both Indian and
Tibetan) dharmic and karmic principles, tenets and practices and
I encourage you to coordinate them with your
conventional health care. I declare that you should consult regularly with your
usual doctor or primary care provider and do all things necessary to insure your
continued good health. I declare that my gentle means of Ayurvedic
Healing Arts and your willingly receiving these services is “the practice of
religious tenets of a church (Medicine Buddha Healing Center) in the ministration
to the sick or suffering by mental or spiritual means as provided by the law”).

By seeing me, you would like to receive a consultation (pastoral counseling)
from the Medicine Buddha Healing Center and/or its appointed Pastoral Counselor, me
Vijaya Stallings, regarding the
Ayurvedic Healing Arts and to receive their sacerdotal spiritual healing
assessment, recommendations of, giving of, and administration of diet, herbs,
exercise, cleansing and rejuvenation programs for the body, mind, and
consciousness (spirit).
You and I agree that these services are provided for a
sliding scale suggested donation as religious practices and tenets of the
Medicine Buddha Healing Center and hence they are constitutionally protected under
the First, Fourth, Sixth and Ninth Amendments of the United States Constitution.
(1st Amendment: “Congress shall make no law respecting an establishment of
religion, or prohibiting the free exercise thereof, or abridging the freedom of
speech…”).
ARTICLE IX, U.S. CONSTITUTION
“The enumeration in the Constitution, of certain rights, shall not be construed
to deny or disparage other rights retained by the People.” Under the Ninth
Amendment to the Constitution of the United States, we both retain the right to
freedom of choice in health lifestyle education services and to pastoral
counseling (as defined above). This includes the right to choose our diet, and
to obtain, purchase and use
any therapy,
regimen, modality, remedy or product suggested by a therapist, doctor or any
other practitioner, educator, or Pastoral Counselor of our choice. The
enumeration in this Declaration of these rights shall not be construed to deny
or disparage other rights retained by us, or our right to amend this Declaration
at any time.

CONSTRUCTIVE NOTICE:
Notice is hereby given to any person(s) or governmental authority who receives a
copy of this Declaration and who, acting under the color of the law,
intentionally interferes with the free exercise of the rights retained by us
under the First, Fourth, Sixth and Ninth Amendments, that they may be in
violation of our civil and constitutional rights, Title 42, U.S.C. 1983 et seq.
and Title 18, Section 241.
We declare all rights reserved without prejudice. We have read, understood and
agree to the above.
